By accessing or using Owl Browser, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the software. Owl Browser is proprietary software available only to authorized users who have signed a Non-Disclosure Agreement (NDA).
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Olib AI ("Company," "we," "us," or "our") governing your use of Owl Browser software and related services.
By deploying, configuring, or using Owl Browser, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our License Agreement.
2. Confidentiality and NDA Requirement
Owl Browser is confidential, proprietary software. Access requires signing an NDA.
2.1 Non-Disclosure Agreement
Prior to receiving access to Owl Browser, including demos, trials, or purchases, you must sign a Non-Disclosure Agreement with Olib AI. This NDA remains in effect for the duration of your license and for a period of 5 years thereafter.
2.2 Confidential Information
You agree not to disclose, publish, or share any information about:
- Technical implementation details, architecture, or algorithms
- Anti-detection or stealth technology mechanisms
- Custom business arrangements or negotiated terms specific to your account
- Any materials, documentation, or source code provided
- Internal communications or support interactions
Note: Publicly available information on our website (such as published pricing and general features) is not considered confidential.
2.3 Permitted Disclosures
You may disclose the existence of Owl Browser only to employees or contractors within your organization who have a legitimate need to know and are bound by equivalent confidentiality obligations.
3. Acceptable Use Policy
Owl Browser is designed for legitimate, authorized automation use cases only.
3.1 Permitted Use Cases
You may use Owl Browser for the following purposes:
- Automating websites and applications you own or operate
- Testing and quality assurance of your own web properties
- Data extraction from sites where you have explicit authorization
- Workflow automation with proper consent from site owners
- Internal business process automation
- Authorized penetration testing and security assessments
- Research and development on your own systems
3.2 Authorization Requirements
Before using Owl Browser on any third-party website or service, you must:
- Review and comply with the target site's Terms of Service and robots.txt
- Obtain written authorization from the site owner when required
- Ensure your use case is legal in your jurisdiction
- Respect rate limits and implement reasonable delays
3.3 Prohibited Activities
You expressly agree NOT to:
- Access websites or services without authorization
- Scrape or extract data in violation of a site's Terms of Service
- Circumvent security measures on sites you don't own or control
- Use Owl Browser for credential stuffing, account takeover, or fraud
- Collect personal data without proper legal basis (GDPR, CCPA, etc.)
- Engage in denial-of-service attacks or abuse server resources
- Use the software for spam, phishing, or malware distribution
- Violate any applicable laws, regulations, or third-party rights
3.4 Technical Restrictions
You also agree NOT to:
- Decompile, disassemble, or reverse engineer any part of Owl Browser
- Attempt to derive source code, algorithms, or data structures
- Bypass, disable, or circumvent license validation or security measures
- Remove, alter, or obscure any proprietary notices or labels
- Share, distribute, sublicense, or transfer the software to any third party
- Share your license key, license file, or activation credentials
- Create derivative works based on Owl Browser
4. Limitation of Liability
YOU USE OWL BROWSER AT YOUR OWN RISK. OLIB AI IS NOT LIABLE FOR YOUR USE OF THE SOFTWARE.
4.1 Disclaimer of Warranties
OWL BROWSER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
4.2 User Responsibility
You are solely responsible for:
- Ensuring your use of Owl Browser complies with all applicable laws
- Obtaining any necessary permissions to access or automate third-party websites
- Any actions taken using the browser and their consequences
- Compliance with the terms of service of websites you interact with
- Any data you collect, process, or store using the software
4.3 Limitation of Damages
IN NO EVENT SHALL OLIB AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OWL BROWSER.
4.4 Maximum Liability
Our total liability for any claims arising from these Terms or your use of Owl Browser shall not exceed the amount you paid for your license in the 12 months preceding the claim.
5. License Terms
5.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Owl Browser for your internal business purposes.
5.2 Hardware Binding
Licenses are bound to specific hardware. Each license allows activation on a limited number of machines as specified in your license agreement. You can manage your license activations through the browser or license management portal.
5.3 License Transfer
To transfer your license to a new machine:
- Deactivate the license on your current machine first via the online portal or API
- Deploy Owl Browser on the new machine using Docker
- Activate using your license key via the environment variable or API
5.4 Subscription Licenses
Subscription licenses require periodic server validation. If your subscription expires or is canceled, the software will operate in limited mode until renewed.
5.5 Termination
We may terminate your license immediately if you breach any of these Terms. Upon termination:
- You must cease all use of Owl Browser
- You must delete all copies of the software
- Your license key will be revoked
- No refunds will be provided for unused license periods, except as described in Section 5.6
5.6 Refund Policy
We offer a 7-day money-back guarantee for new license purchases. To request a refund:
- Submit your refund request within 7 days of your initial purchase date
- Contact us at support@owlbrowser.net with your order details
- Refunds are processed within 5-10 business days to the original payment method
This refund policy does not apply to: subscription renewals, license upgrades, custom integration services (Business/Enterprise tiers), or licenses terminated due to Terms violations.
6. Indemnification
You agree to indemnify, defend, and hold harmless Olib AI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of Owl Browser
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable laws or regulations
- Any content or data you collect, process, or store using the software
7. Updates and Modifications
7.1 Software Updates
We may release updates, patches, or new versions of Owl Browser at our discretion. Some updates may be required to continue using the software.
7.2 Terms Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the software. Continued use after changes take effect constitutes acceptance of the modified Terms.
8. Governing Law and Disputes
8.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
8.2 Dispute Resolution
Any disputes arising from these Terms or your use of Owl Browser shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in DeKalb County, Georgia, unless otherwise agreed by the parties.
8.3 Class Action Waiver
You agree to waive any right to a jury trial or to participate in a class action lawsuit against Olib AI. This waiver does not apply where prohibited by applicable law.
8.4 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
8.5 Entire Agreement
These Terms, together with the Privacy Policy and License Agreement, constitute the entire agreement between you and Olib AI regarding the use of Owl Browser.
